So based on the calculations used by this judge, what do you suppose the fine should be for all the folks launching "denial of service" attacks on the Obamacare website?

I'm thinking something in the hundreds of billions.

When it said he'd ordered restitution for losses not incurred. Restitution is an "equitable" remedy, and the judge clearly skipped that day in law school. Unless, of course, he got his degree from Liberty.

In the early days of the Internet, the ultimate penalty for bad behavior (such as a denial of service attack) was something called Internet Death: Nobody would accept or forward your data packets, so even if you still had a physical connection you were effectively cut off from the Internet. Your DOS packets would just get discarded by the first computer you did not own, on its way to the Internet, so your attack would only clog your own local area network. If you were caught generating such traffic by your company or school IT department, you got fired or expelled. (Since the entire institution's Internet traffic might be dropped as well.)

I think we need to require a feedback system so every computer connected to the Internet can respond to an Internet Death warrant once more. This would work much better than selective persecution of some dummy who mounted a DOS attack from his own computer, and would also destroy one of the most effective weapons of bot-net hackers.
