On January 3, 2017, Democrats will hold the majority in the Senate for a few minutes, until the newly-elected Senators are sworn in. Biden could convene the Senate in those few minutes and call for a vote. The majority could then suspend the rules and vote in Merrick Garland.

Crooks & Liars

Do Dems have the balls to pull this stunt off? (Sadly, I don't think so... cry )

To me the question should be, should they take advantage of this tiny window, if it were even to exist?

I am not enthralled with their nominee, but the Democrats lost this election IHMO because they have no balls, think everything through too much and therefore look week and indecisive.

Personally I think that is a good thing, but clearly many voters do no.

Here's the thing.. If this ploy would work, it should be used to restore a semblance of balance. On the other hand, it would pretty much guarantee that the new Congress would eliminate the filibuster, which is the only real check Democrats still have.

I think that ol' handsome Joe should pull-off this stunt AND THEN spend the next for years running for POTUS in 2020. smile
