Justice Kennedy is NOT gonna to retire. I provide as my evidence: How This Supreme Court Case Will Affect the Next Election - TIME. I don't think he'll retire before writing this decision. He's been waiting 13 years for this case.

I'm a bit curious about the Supreme Court decision to let a tiny bit of the travel ban EO take effect. Wasn't the purpose of the travel ban so we could be safe while the INS et al reviewed their vetting process? None of the TROs stopped that review from happening, they just kept people traveling. It's been over 150 days since that EO. Haven't they finished the process review? What have they been doing? Not reviewing the process? I'm sure it doesn't require every single INS employee to do it. Do they really want thousands of INS employees sitting on their thumbs while a 10-20 member board thinks about improvements for 90 days.

Isn't the ban now moot since the required 90 days is well over? Or has the "process review" always just been a sham? Theater so it LOOKS like Trump is accomplishing something.

Trump is all theater without substance. I think the semi-lifting of the ban is also theater without substance. If one's concern is "judicial activism", their approach is a pure example of what that is: substituting their opinion for the president's. It is also indicative of their thought processes. It takes 4 votes to accept a case, but 5 to stay the decision. They didn't have 5 votes to overturn, but don't agree on a reason. The "baby splitting" option protects the majority of visa applicants, and gives the administration time to develop their "vetting" procedures. By the time the case comes up, it will be moot. (Remember, one of the judges blocked that, too.) Ultimately, the only "harm" is delay, not denial - so, those with "bona fide ties" already won, and the rest will win, but in a few months. I think it will be a 6-3 decision, with only the Thomas-Alito-ScaliaGorsuch bloc dissenting. Roberts/Kennedy were hung up on the process.

More specific prediction: 4-2-3 decision, unless Roberts decides to vote with the T-A-G bloc to boost his "conservative" status. If not, he writes the decision (my bet). Otherwise, Sotomayor or Kagan does. Kennedy and Ginsburg want to write important decisions. This will not be that, but a discussion of process. (Unless one of them wants to write a decision about "balance of power"- then it's a tussle between Roberts and Ginsburg.) Overall - 3 opinions, with one concurrence and one dissent.
