Unless the Dems can pull a McConnell and force a delay until January. Long odds

The Republicans opened the door for this tactic.

Keep your eye on the case that's gunna put property above people Rick. The end game is to rip out the legal legitimacy of government to redress inequality. That will protect their hoard from government forever. Posted link to article in the 'realize what they're doing?' thread but it didn't gain much traction. It;s a dive into a legal/political/economic strategy decades long and revolutionary in design.

The implications are broad and will be devastating for the 90%.

Don't be so disheartened. Kennedy was never anything but a conservative. Sure he made a few votes for rational decisions but he also voted for a bunch of Very Bad Things. Anything Trump does can be revoked by the next Democratic President. Anything the Republican Congress does can be reversed by the next Democratic Congress and President. Bad judges can be impeached. In the meantime, bad Republican policies demonstrate they are stupid and unworkable to voters and courts.

If the new Supreme Court overturns Roe v Wade, and states move to make abortion illegal, then women will go to other states to get them. In the bad old days, they went to Mexico. The drug dealers will start carrying RU-486 along with their coke and heroin. Abortions might drop but "spontaneous miscarriages" will soar. And then maybe women will be willing to vote for a female President.

And look at the big picture: Demographics are changing in America. Old people die and people of color have more kids. These are the death throes of Conservatism and White Supremacy.

Yup, Caucasians to become the minority in 2040. THAT is what Conservatives are so freaked-out about. Hmm

Into every life a little crap has to rain down. It may take a while, but the sun will come out again. There is such a thing as equilibrium. When things get really bad, the mob starts chopping of the aristocrat's heads, the assassinations start, and some people start eating the 1%.

Ultimately, we all die. It doesn't matter if you have all the money, you still die. At some point you have to think about how long the line will be for people to piss on your grave.

In Hell, people sit at a full table with all kinds of wonderful food. Their hands have been replaced with very long handled spoons. They are starving for all eternity because the spoons are so long they can't reach their mouths. Heaven is the same: Full table with wonderful food. Same long-handled spoons. Every body is eternally happy because they all feed each other.

Except...the mob is cheering them on. Making death threats against anyone who disagrees with the aristocrats. The pitchforks and torches are heading down the hill from the castle to raze the village below.

We are living in Bizzaro World where everything is backwards and upside down.

They have plans to stop that too. Police are already using black folks for target practice. ICE is jailing brown folks as fast as they can build gulags.

The President has said he'd rather not use due process since it slows the deportations down.

So let's talk some more about that 2016 election and try to break up the Democratic Party..... coffee

The only reason the Republicans are attacking the Democrats so hard is that you attack your opponent on the very issues you are most vulnerable on. They are trying to make the most of the Socialist/Democrat split but their Party isn't even Republican anymore! Between their donor class, Chamber of Commerce Republicans, Evangelicals, the Freedom Caucus, and Trumpists, they can't even pass bills because of infighting. Trump is running them right over the cliff of Putin-backed fascism.

They are going to have to put together a new coalition very soon, if they want to get anything done. Otherwise voters are going to see a Democratic Party of reasonable non-disruptive ideas versus a ragtag collection of crackpots with conflicting goals.

Exactly! This is exactly why the GOP can't legislate. Instead they will "legislate from the Bench." cry

Word on the street is that it's Democratic obstructionism. Like that family separation thing...It's a Democratic Law and they refuse to change it. Trump's hands are tied...he has to separate the families as per Democratic Law.

Anyway, point is, IT'S THE DEMOCRATS FAULT!

That gets a little thin when the Republicans can't pass an immigration bill to save their lives. Even God-Emperor Trump calls them out for it.

On its face, it's pretty hilarious. No legislation is draconian enough for the Freedumb Caucus. No bill can reach the floor unless they don't need Democratic votes. Consequently no legislation gets passed.
Which is probably a good thing.

Yep: That's why the Republican Party is dysfunctional now.

I am home from a LONG trip, and ready to rejoin the fray. To answer a direct question: Yes, Rick, Justices (and lower judges) can be impeached. It is just very hard to do it. Much better they never get confirmed in the first place, but that is also difficult to prevent when the controlling party has a lock on the process.

Let's face reality: the Republican party is playing without principles, and the Democratic party has always been more reluctant to ignore laws and principles. As Michelle Obama put it, "when they go low, we go high." Republicans see this as weakness, because, frankly, bullying is in their DNA. (I can cite centuries of evidence to support that statement.) I am not suggesting that the Democrats adopt the Republican strategy entirely, but they should be aware of it and counterpunch when appropriate and point out the utter lack of morality of the GOP constantly.

One example is the judicial appointment history of the parties. Democrats, by and large, appoint moderate, rational, non-ideological judges, and follow the standard practices for advice and consent. Republicans block Democratic nominees, slow-walk the process when Democrats have nomination powers, and libel the nominees and courts whenever possible. When Republicans control the nomination/advice process, they jam ideologues through the process, skip formalities, consent to marginal qualifications, and have successfully stacked all of the courts with their radical nominees. To wit: Gorsuch. He's not the outlier, he's proof of concept.

As was pointed out earlier, Kennedy was never a liberal. He just happened to have a soft spot on certain issues. But Alito, Thomas, Roberts, and Gorsuch are the new four horsemen of the Supreme Court. Ideological conservatives who vote as a bloc on every issue. Consider this: When Sandra Day O'Connor was appointed by Ronald Reagan, it created a stir both because she was a woman and because she was VERY, ideologically, conservative, and would tilt the balance of the Court. She became the "new center" of a Court that skewed conservative. Kennedy then became "the center" - even further right. Now Roberts will be the "swing vote" of the Court. Considering how far right Roberts is, Katy-bar-the-door. Justice Kennedy May Soon Find Himself Disappointed And His Legacy Undermined - npr.

If Garland had been confirmed (as he should have been), the balance of the Court would still be skewing rightward, but there would still be a balance. In all likelihood, the skew to the right will be insurmountable in my lifetime and yours, and big money is playing to assure that: A Lifetime Investment: Big Money Pours Into Supreme Court Battle - npr. These are the highest stakes we've faced since 1935, and the odds are far, far worse. I suspect that there will be a 6-3 skew before the end of Trump's term. And they have already established their armory: How Conservatives Weaponized the First Amendment - NYT (subscription).

Addendum: It’s not just abortion: 5 issues likely to be affected by Kennedy’s exit - Politico.

If the Democrats took the House and 2/3 of the Senate, they could impeach some judges. In particular, the judges that were rated "unqualified" but installed by Republicans anyway would be at greatest risk. That would give their impeachers some cover instead of being blatant partisans.

Republicans have no problem with blatant partisanship, but Democrats usually try to do things "for the good of the country".
