His counsel of record, Bryan A. Stevenson, head of the Equal Justice Initiative in Montgomery, Ala., says it was undisputed in the penalty phase of Madison’s third trial that he already “suffered from a mental illness marked by paranoid delusions.” ...

Madison’s case compels us to focus on the death penalty in its granular reality: Assisting someone who is non-ambulatory, and bewildered because he is (in Stevenson's phrase) “memory-disordered,” to be strapped down so an executioner can try to find a vein — often a problem with the elderly — to receive a lethal injection. Capital punishment is withering away because the process of litigating the administration of it is so expensive, and hence disproportionate to any demonstrable enhancement of public safety, but also because of a healthy squeamishness that speaks well of us...

I'm not completely against the death penalty. Some folks simply do not deserve to live. By the same token, they don't deserve a peaceful comfortable death either. The folks I'm talking about showed no mercy in their crimes and deserve none in their punishment.

I don't mind executing people either. But you should never do it when there is any possibility of a mistake. Sometimes there is no possibility they got the wrong guy. Like a hostage situation where they know who the bad guy is. Or a bank robbery where the robbers are captured leaving the bank.

I don't want anybody executed just because they look like the person who did it. Eye witness testimony is often worthless, unless the witness knows and talked to the perp at the time of the crime.

Here's MY problem with the death penalty:
I don't have any issue with putting an egregious and despicable criminal, such as a serial killer, to death.
I just don't trust the state to "get the right guy" because all too often they HAVE put the wrong people IN PRISON, and put the wrong people to death.
States do it all the time, and state AG's, prosecutors and judges behave as if it's a personal affront for them to have to admit that they might have made a mistake.
Well, if that's how it's going to be, then screw it, NO ONE gets put to death.

And I agree. If you really need a trial and jury to decide whether someone is guilty then the death penalty probably shouldn't apply.

Yeah, I agree about prosecutors. We have no penalties at all, for malicious prosecution. Some of the crap they pull is a crime against humanity. Every prosecutor needs to get credit for innocence as well as guilt. I want prosecutors who are devoted to truth, not conviction. Any trial with a speck of doubt should take the death penalty off the table. Any prosecutor who hides evidence, makes stuff up, etc. should be disbarred.
